Did you get her insurance info? More often than not, even if she doesn't think she was at fault and the report doesn't clearly define it, her insurance will likely just pay up bc it'd cost them more to fight it than to just fix it... happened to my cousin, completely diff situation, but he was 100% sure that it wasn't his fault and the police report didn't cite him, but his insurance refused to fight it and just paid for the damages...

Trust me being a Police officer , you get lazy ones where you have to force them to do work and then there are great ones where they will take and measure skid marks and also pics of damage for court. And since you were rear ended the person no matter what should be cited according to AZ State Law. It is esp. better to get wittnesses to make statements and to get their phone #'s. No person or Police officer can determne that any damage was already done to the car. Most insurances will do a 50 % fault and for the police report you should be able to have it sent to ya or go down and pick it up, the SGT. has to review all reports and then they get processed and the you can get a copy. Sorry about your car and hope everything turns out good for you.

In Texas, if you run into the back of someone, it is your fault-very few instances it is not. She should pay no matter what.
