      Another thing... Its not even all about me being scared of an attack (although I am). He should be scared that his dog is going to harm a customer, or someones pet in the area, or a child, etc.. and lose his business, and / or everything in a lawsuit.

                    the thing is, you dont have to quit, and he cant fire you...you can tell him you refuse to work with the dog not tied up...when he ties the dog up then you'll work as you'll feel its safe.

                    He HAS to pay you while you refuse to work, and he cannot fire you...so why would you quit?

                      Are you sure the American labour laws are the same as ours? I know what you're saying is true in Canada.... I assume he isn't unionized, anyway.

                          I can't see why it wouldn't/shouldnt be...that law is there to protect workers for these exact situations...

                          you don't even have to be rude with the guy, he knows his dogs not normal...tell him straight up, you fear for your safety with the dog loose, ask him nicely to tie it up while you are there otherwise you will refuse to work...if he tells you "quit if you don't like it" tell him, tie the dog or I get the MOL, simple as that...if he fires you...contact the MOL and they will tell you step by step what to do and will launch an investigation.

                          I would say even right now contact the MOL and just ask them what your options are and how you should proceed. They'll tell you exactly what your rights are and give you advice.


                          I would NEVER quit a job because the work is unsafe...they are obligated to make it safe...and if w.e is unsafe takes 3 months say to make it safe...theyre obligated to pay you for that 3 months (or however long it takes) while they make it safe and you are engaged in a work refusal.

                            OSHA, or Occupational Safety & Health Administration is responsible for enforcing reasonably safe working conditions. I'm pretty sure you can't just walk off the job and expect to collect a paycheck because an individual determines its not safe. If that was the case there would be no one to diffuse bombs or deliver pizzas unarmed.

                            OSHA has a lot of personnel; I'm sure they would be happy to stop by if you made an anonymous call.

                              if you are declared an essential service (i.e police/firefighter/ambulance/bomb squad etc etc) then no you cannot refuse unsafe work as your job revolves around unsafe work...but you are paid accordingly

                              Usually if your work place is big enough they will have a JHSC, you would start the process by going to your supervisor and telling him the work you are doing/conditions are unsafe and that you refuse to continue to do that job as the conditions are unsafe (but you will resume when it has become safe). The supervisor will evaluate the situation and has 2 options He can either A) make it safe for you, or b) take you off that job and place you elsewhere, and get someone else to do the job...however, in order to get someone else to do the job he has to inform that individual that you have refused the work because it is unsafe. If the next worker feels he can accomplish the task safely (usually because they are more certified or have better training etc) then they can do the task. Your supervisor/boss will then put you doing other safe work, or can send you home if there is nothing for you to do...BUT he has to pay you for the day, he cant send you home without pay (again that law is there to protect the worker so that they are not bullied into doing something unsafe because they need to put food on the table with that money)

                              IF the work is determined to be unsafe for any individuals to accomplish the task, the MOL will come in and shut whatever it is that is unsafe down until it meets safety requirements.



                              In the case of a rampant viscious dog, the MOL will most likely tell you to talk to the supervisor about the dog, if the supervisor refuses to contain the dog, the MOL WILL COME IN...it is a health and safety hazard for more than one reason...the dog could transmit diseases to you if you're bit, it could physically insure you, it could kill you...


                              you can't just walk off the job and not tell anyone, there is a process, and yes you can/will get paid if they have to send you home because you refuse to work with the dog present.

                                You can also go to the Fedral EEOC For unsafe working conditions and they are free , I had to do it in my early 20's for a job I was working at and they came through like a champ for me. Scared the piss out of the employers I was working for, soon as the feds get involved the nicer the working surroundings got. They will fine the employers so much for every event. Plus if your employer tries to fire you over it , EEOC will fine them and you will still have your job. Its worth a try at least or just tell your boss thats what your going to do if the working conditions don't improve.Good luck.
