  • I need some legal advice???

    this is the story.

    I ask my girlfriends dad to help me put on my exhaust as a favor. well, we got everything done and then we noticed the the passanger's side tip was hanging out from underneath the body and i ask him to fix it. he said ,what i thought was joking, that he would cute the eccess of the tip off and grind it down. well, i told him hell no and that he needs to jus cut the tip off at the base and cute the eccess off the tail pipe. and he got under the car and i thought he was going to do it. well, i walk away and turn around and right then he starts to cut at the end of the tip w/ his torch and i was like "what the ****". well, when he was cutting it w/ the torch, he pretty much caught my bumper on fire and now its messed up. when i got pissed, he told me he was doing everything for free and what do i expect. then he went on and said, "well, sue me" and i said ok and then he threatened me by saying he will take the exhaust sort of like mechanic hold. and i was still shocked. so i just high tailed my car to my house and threw it in the garage. If i have to sue him, do you think i would win in small claims court? i mean come on, he was doing a favor and i told him not to do what he did that caused the problem.

    I think you get what you paid for.

    If you went to a real shop, they would have insurance to cover accidents like that.

    You may want to talk to a lawyer, but don't get your hopes up.

      he cant "hold" the exhaust. There was no agreement to pay him in the first place. Likewise, there was no agreement/ insurance protecting you against his work.
      Your engaged to his daughter (you did call her your fiance, right?) for Christ sakes. not worth the $300 to fix the bumper, and the guy was just trying to help you out. Cut your losses, shake hands and both of youapologize for being pricks threatening to sue each other.

      BTW, all you need to do is watch a couple episodes of Judge Judy and you'll figure out exaclty where you stand in small claims.

          How is this even quazi law related? This seems more appropriate for the Jerry Springer show or Judge Judy.

          He was doing you a favor and he messed up, you should have not been so upset and instead both tried to find a way to rectify the situation together. However you started acting like an as* and he got pissed. Now you're on the bad side of your girlfriends parents and have a burnt bumper that is only going to be fixed out of your pocket.

          Do you not realize he is your girlfriends dad and not just a exhaust shop mechanic? Where do you get off feeling as if you even have the right to yell at him because something went wrong and are now trying to find a way to take him to court. If he was a mechanic at an exhaust shop and you paid him to do this then by all means you have every right to be pissed and they should be required to fix your bumper, but its your girlfriends dad doing a favor for you at no cost.

            You guys are forgetting that he told 'Dad' not commit the act which caused the problem -- so in that regard, 'Dad' was in the wrong.

            HOWEVER - I still don't think you'd have a leg to stand on in court.

              It wasnt until my early twenties and only reagarding questions in which I was degreed and had experience that my dad has ever listened to me on anything. anything outside that particular specialty, he still "knows best." I dont think Ive ever had a g/f's dad that would listen to me regarding anything, they ALWAYS knew best. Its the nature of the beast.

              If you want a professional job, pay a pro to do it. Otherwise, you are accepting liability for any and all other possible outcomes... especially with free help.

                Yep, it's just a car. I'd apologize if I were you. Nothing to get upset about. You can always get a replacement buffer if necessary.

                You took the cheap route. You should of seen this coming.

                  You could win in small claims. He did what you told him not to do.

                  But you will lose something far more valuable if you go that route.

                    Call your insurance company and see if they will cover you for a new bumper. Explian to them exactly what happened and they might cover you.
                    As far as court, I agree with the majority, you don't have a chance.
                    He should at least help you pay for the mistake he did. I know if I was him, I would have felt really bad and offered to help pay for it.

                      Yes I would too... that is the right thing to do. However if some punk little kid started yelling at me I would have said f*ck off and burnt his bumper more.

                        ok, i dont sue him but i have no way to pay for it to be fixed. threw insurance or not.

                            thats a good point but

                            1: there seriuously arent any jobs. no joke.
                            2: im leaving for florida in july so its stupid to have a job for 3 weeks
                            3: My mother wont let me have a job during school cause i have a stress induces illness. so going to school and working tell 1-2am and then school in a few hours just doesnt do it for me.
