        Here's an update, guys:

Topeka, Kansas) The Kansas Senate didn't go as far as it wanted in restricting the Rev. Fred Phelps and his followers from picketing and protesting at funerals of U.S. soldiers killed in combat, but it got its message across.

This week, the chamber voted 40-0 for a bill restricting such activities near any funeral. The bill goes to the House, where it faces a bright future.

During debate, senators didn't mention Phelps or his Westboro Baptist Church by name, but acknowledged the bill was prompted by their activities.

''Perhaps the most vulnerable time in a person's life is when they're burying a loved one,'' said Sen. Jean Schodorf, R-Wichita. ''I believe we, as Kansans, need to make a statement that we want people to be able to bury their dead in peace.''

While the measure doesn't single out Phelps or his followers, it clearly was prompted by recent protests by them around the nation at soldiers' funerals.

Phelps and his followers contend the deaths are God's vengeance for the U.S. harboring homosexuals. For years, Phelps and members of his independent church made up mainly of family members protested funerals of AIDS victims, but now have shifted to soldiers.

Kansas is among 14 states this year working on legislation restricting protest activities around funerals.

The bill bans picketing and protest marches within 300 feet of a funeral service one hour before, during and two hours after the service. Violations would be a misdemeanor. State law now says only that it's illegal to picket ''before or about'' a funeral service.

During committee hearings, Stephen McAllister, University of Kansas Law School professor and constitutional scholar, cautioned that a 300-foot buffer zone in most instances would extend to streets and sidewalks, which courts consider public forum areas.

As a result, the bill was reworked to overcome concerns about encroaching on freedom of speech. It exempted from the 300-foot buffer zone streets, sidewalks and other public spaces. It would keep protesters off private property, including where the funeral was being conducted.

''I know there are constitutional problems with taking this farther. I wish it could be 1,000 yards or 1,000 miles,'' said Sen. David Wysong, R-Mission Hills.

The bill also makes it a violation if protesters ''obstruct or prevent the intended use'' of a public area while engaged in picketing or protesting.

When the Senate Federal and State Affairs Committee heard testimony on the bill Feb. 1, Phelps testified against it and threatened legal action if it became law.

''We can't be lawfully moved out of sight of our target audience,'' Phelps warned the committee.

He also said the bill violates First Amendment rights and targets his church's religious beliefs.
