  • Accident advice?!?

    Ok, my little sister's best friend was backing out of my driveway a few weeks ago and hit my car that was parked in the street. She hit the driver side from bumper ... paint scuffs and a nice big crack that goes all the way through. Her insurance guy came out, took pics, all that fun stuff, and determined that she hit my passenger side?!? WTF?!? They said there is a paint scuff on the passenger side (which there isn't) and that she didn't make that crack. BS! She even told me she hit the driver side and made that crack! There are scuffs and a huge crack on the driver side, NOTHING on the passenger side. My mommy is going to talk to our lawyer because they are only sending me enough money to get the nonexistent scuff off the passanger side ... when I need a whole new bumper!! AHHHH!! What should I do?? My insurance company can't do anything cuz I have liability only. Any ideas?!?

    My sister's friend is fuc*in' this all up ... saying people were in the car that weren't, and someone who was in the car wasn't. She didn't even tell me 'till 3 days later! She said my car was sticking over the driveway, which it wasn't ... if it was, how'd she get in the driveway!? HELP!!!

      did you get a police report?
      little late if you havent, but you might try them anyway.... then call your lawyer. oh.... and DO NOT cash the check that they send you. if you do, that basically means you are accepting that as settlement and the issue is dead.

        I didn't want to file a police report cuz she's my sister's BEST friend. She didn't tell me when it happened either, I found out from another of my sister's friends a few days later!! I don't know when it happened, what time, anything! All I know is how it happened ... and even some of that if all fuc*ed up now!

        I thought about the check they are sending too. It's gonna be hard to just stare at it and not cash it!! LoL BUT, they next check they send me better be 5 times this one!!

          !!!DO NOT!!! cash that check. Get ahold of her parents/ insurance company and DEMAND that they make it right or you will contact the police to file a hit and run/ leaving the scene of an accident report and get your lawyer involved. Otherwise, I gaurantee you will get nowhere but screwed.

            Seems like the govt needs to get involved in regulating insurance.

            Couldn't you constitute what they do as fraud?

            Make a fradulent claim about something that was stolen or whatnot and you get in trouble.. it should work the other way around too!! They rip you off they should get in trouble...

            I don't know how they have gotten away with this **** for so long, its ****ing gay.

              I third that. Call them and scare them with threats of getting the police involved and stuff.

                But we've already contaced her insurance. Can I still file a hit and run?? I spoke with her psychotic father this morning and he screamed "Sue me, sue my insurance!" I am going gto try to get the estimator guy to come back out here. He took pictures of the car and I want to see them! I just don't understand ... there is no damage to my passenger side, only the driver side! I am going to try to take pics in a little bit. Can anyone host them for me??

                  Take it into the shop that they recommend and just tell them to fix the car. Act clueless, why would you be cashing the check anyway. The insurance always will give you a quote that's way lower than the actual price to fix it.

                  If you take it to their shop and they see there's no damage on the one side they will cll the insurance and talk to them for you.

                  That's what I think I would do anyway.

                    It is too late to file a police report. Since you failed to file a report in a timely matter, there is no crime. So the police will not involve themselves. That has to be done when you first see the damage, or within a short time after. There is another thread that covered all this.

                    The adjuster already came out and made his judgement. It is unlikely they will change their mind. If the paint scuffs you speak of are from her car, then you will win in the end. Maybe.

                    A new bumper will cost around $795. Mine was hit, and instead of a sanding and a paint job I got a new one. The figure I gave is what it cost the insurance company.

                    Forget a lawyer. You are talking small claims, and no lawyer will take it. You will have to pay him $175-$200/hr, because a contingency fee is out of the question.

                    But do not cash the check till after you try to fight.

                      I wasn't going to cash the check. And I didn't 'fail' to file a police report ... I figured since I didn't find out about it 'till a few days later, it was already too late. If she would have told me immediately after she hit me, I would have probably filed a report.

                      Her insurance didn't recommend any body shop. Hell, they didn't even call me! They just called her and told her they were sending me a check for $383.00, the cost of the scuff on the passenger side (remember though, there IS NO MARK OR DAMAGE on the passenger side!!) I'm hoping maybe the estimater guy just messed up, cuz it's total bullsh*t! The girl who hit me even told me she hit my driver side! We 'role played' and she showed me what she did. AHHHHHHHH this sucks!

                        I don't really get it either, when I was hit a while back, insurance company (the other guy's) took a recorded statement from me over the phone of my version of what happened. They did the same from him. His insurance paid for everything in the end, no adjustor looked at my car, the shop I went to right after sent all the info and estimates to the insurance company for me and they hashed it out... my car was fixed and I never paid a dime. I thought all insurance companies did recorded statements like that. Then it would be pretty obvious what happened, unless she lied. Tell the company to get a statement from her?

                          They got a statement from everyone ... even got my little sister (who isn't the best to talk to about things like this). My sister had JUST turned 18, and they went after her. They recorded everyone. The adjuster guy must have just fuc*ed up, cuz it makes no sense at all!!

                              I just called the guy again today ...he said things are 'under investigation'. The girl who hit me lied about who was in the car, apparently my sister gave a false statement (she's LD and shouldn't have given one in the first place), and there's more that doesn't add up (like why there are no marks on my passenger side?!? haha). I hope this is a good thing! My mommy thinks it's cuz we threatened our lawyer ... MuHaHa! I'll keep ya'll posted ... thanks for the advice!!
