  • So what do you think of this situation?

happened awhile ago locally, guy just got sentenced...

    cliff notes...

guy on bike races a porches

FHP in ls1 sees it, does a u-turn "tries" to catch up to them(losing battle imo) and gets to a high speed, gets a tire blowout, wrecks and dies.

It was radioed in the guy on bike was caught down the road. Guy in porsche gets away. Guy on bike claims he never even saw the cop car(believeable, we are talking a crotch rocket and a bike, a stock ls1 woudl get wasted, and have a hard time watching them go buy and catching up)

The guy was just sentenced to 30 years in prison.

I am not a "yay go streetracing" kind of guy, but I think this is a little out there for punishment.

sounds like some BS to me.

its not the fault of the now convict that the officer died.

While I don't like street racing that is too much.

Is 30 years pretty common for involentary man slaughter (I assume thats what the charge was)?

it isn't his fault the cop died, he just had bad luck, his tire was prone to blow out anytime so he could have died any other way.
so what they are basically saying is that if I for some reason follow someone somewhere and my tire blows out its their fault for them going too fast.
the judge is a moron, he just wanted someone to get punished for the death of a cop.

The police should have never been in a "high speed pursuit" in the first place. If they are pushing 130+ trying to follow a bike that WILL top out closer to 200mph, that IS reckless indangerment on the law. A radio does the job just fine, as does a helicopter.

As much as I hate to see someone lose there life, the rider should not be charged with manslaughter. Reckless, sure... careless, yes... speed, duh... but not manslaughter.

            Exactly...

whats kind of scary doubt it woudl happen but you never know.

Say I am speeding or doing any moving violation, and the cop gets a blowout crashes and dies, before I pullover.

I coudl get busted for involuntary manslaughter and get 30 years. There is already precedent to this in court now.

I wonder if the dude had a good lawyer. I can see a list of other people that can be held accountable for this, but only in a very small degree the biker.

                - The tire manufacturer for a faulty tire.

                - The cop himself for taking his car to a speed above the safe limit for his vehicle. (ex. If he drove faster then the rated tires allowed)

                - The station for not servicing the car properly.

                - The station again, for not properly training the officer to keeping his cruiser at a safe speed. (ex. If he drove faster then the rated tires allowed)

They wanted to make an example out of this guy, plain and simple.

Its very unfortunate for the officer but a ridiculous sentence. If he hit and killed a bystander, then thats obvious neglect and manslaughter. But apparently the DA proved the rider neglected the life of an officer because obviously everyone should know full well that if a cruiser is not maintained and serviced properly, its your ***...
