(6 year Navy veteran, Naval Reservist, & Uncontracted Army ROTC - I'm kinda familiar with military protocol)
This is not a traditional fight. Our ENTIRE military structure has been based on fighting battles with people that fight by a particular code. Even in WWII we (the US of A) did things that weren't considered "friendly" (imprisoning Japanese citizens, firebombing german towns, etc...) However unfortunate though, it was NECESSARY on a national level. And before someone starts complaining about it, I'll be the first to admit it was wrong, but fortunately, our way of life continued, and I can sit here, write this and say that I'm glad they did it.
Now with this particular soldier... Haven't seen the video so can't intelligently speak on it. It's probably one of those big "grey" areas that pertains to the rules of engagement (which for those of you that don't know are "vaguely percise") (notice the oxymoron) and are some politicians way of putting rules and limits on something that you can't successfuly do that too. "with the first bullet that goes past your head all the politics in the world go right out the window" and thats the reality of the situation (unfortunate once again).
