As I was driving home tonight at about 2am. I passed two different cars that were pulled over about 5 miles in between, in both cases, they were out on the sidewalk doing the ol' drunk test. One was a well dressed man in a econobox, and the other were some post teen hoodlums.
Ive never been pulled over for a DUI, but it made me think. If they ask you to step out of the car and perform the test, you are basicly arrested at that point and the test is just about pointless, but procedural in order to give the illusion that you have a chance.
As long as the stop was because of suspsion of DUI, and not a broken brake light. The officer bacicly makes his judgement right there and then before even speaking to you.
I find it hard to reason that he will allow you to perform the test, and he would be so impressed on your performace he would let you back in the car and drive off.
One reason being, he is most likey not the only cop there, and if he had bad judgment in "calling" the DUI, would show weakness in his judgment in front of his peer officers.
The second being, if you were to perform reasonably well, and he let you drive home, and you cause a big accident and killed somebody. His judment would be scruitinized and he could possibly be blamed for not preventing the accident.
Do either way, you going down to the Station to blow your lungs out in the machine. If you are over, then good job for the cop. If your under, you are still gonna have an arrest on your record, and still have to get your car outa impound, and possibly waste a whole lot of your time.
I don't feel compassion for drunk drivers, I just hope that I never get into that situation. I never have more than one drink, If I know I have to drive. But I have driven more impared due to lack of sleep, then EVER Alcohol.
It just reminds me that in order to have a little freedom, we have to give up so much freedom.
And of course Don't drink and drive.
