ok heres what happened last night.before few days this girl around maybe 25 years started arguing with my mom for some reason,she called my mom all kinds of stuff you can imagine.after my mom told me what had happened I went down to that womans apartment to ask her why was she calling my mom all kind of ****.I knocked and the door opened with her and her husband or bf Im not sure were standing on the door.I started asking her why she called my mom ***** and all that stuff and she started arguing with me.all I told her was not to talk **** to my mom like that and if she does I will call her the same.after I said that her husband had this mean face on and told me if I say something to her he will **** me up and all that ****,I told him whatever man and he got up to my face and was about to him me,I told him go ahead he can try.then he started telling me to get the hell out from there.after I started leaving trough front door of the apartment building he was telling me that he will **** me up and stuff.before I opened the front door I told him I'll will do the same thing to both of them.right when i opened the door I heard him started running towards me.at that time my back was facing him so I had no idea if he was going to attack me or not.then all of a sudden he grabbed my neck from behind and he pushed me towards.at that time we both slammed against this van that was parked in front of the building.I then slipped on the grass while he was trying to knock me on the ground.thats when I fell and hit my head on the concrete hard.then he was on top of me and trying to punch me in my face.he was much bigger guy than me maybe around 250lbs.I blocked his first punch with my hand while lying down on my back trying to get him off me.the second time he punched me right in my RIGHT eye.thats when my dad and sister heard what was happening and came rushing to get him off me.then when I got up my sister was telling me to call the cops.so that what I did.after few minutes the cop came and I was trying to tell him what happened with my neck bleeding a little bit.the cop had really mean face and told me to get away from him while grabbing his gun.the medics came too and they checked my eye and my head for injuries.then that cop came inside the ambulance and told me to came with him.as I stepped outside with him he asked the other cop if he took my info.the other cop said yes and this cop told me to sit in his car.my sister and my dad were smoking a cigarrete at that time and started telling the cop what had happened.he was of no interest in listening what they had to say and told them both to throw away the ciggaretes from their mouth because he hated smoke :mad: .and the he told my sister and dad to go inside the apartment while all these other people were left alone to stare what had happened.then the cop went to talk to the guy that attacked me and after few minutes put him in another cop car.I thought he was going to be arrested for doing what he did to me.after few minutes the cop took me up to the police station,and took my fingerprints a hundred times and took my picture.I was asking him why was I under arrest when I did not do a damn thing.he told me I was under arrest for Disorderly Conduct,just because I was trying to defend myself.he told me if Im going to be an *** that he will take me down to jail.I just kept my mouth shut with my right eye being swollen as hell.after I was done he told me that I could go and not charge me with an assault.my mom came to pick me up and when I came down to my apartment the guy that just had assaulted me for no reason was free to with no charges against him.so what Im trying to say here in he kicked my *** and my right eye is all red and black while I didnt have a chance to hit him.
only thing I can do is file with the court against him and that mean cop that didnt do a damn thing.

so what do you all think I should do??the doctor told me that the inside of my eye could be red up to a month or so.while im here sitting and writing this with this pain on my eye and head the other guy is happy

Damn man, that sucks big time. I would say drop it because it's not worth your time to pursue it any further. You're not going to get any satisfaction out of taking it to court if the cop that reported to the scene was acting like that. You could try talking to that cop's superior but I seriously doubt anything positive would come of it. As I said above, pursuing this incident much further is probably a waste of your time.

I am not a lawyer so my advice may not be the best.

Personally if I were in your situation and the inncident indeed happened that way then I would immediately hire a lawyer. You could sue him and/or press charges. I would definately not rest until the charges against you are dropped. 10-15 years down the road a background check might show up with that information.

Secondly, I would be down at the PD raising hell with whoever is in charge. There is no reason for an officer to treat the people who pays his salary like ****. It's always a few bad cops that give the rest a bad name.

Good luck with whatever you do. I'm sure you're still probably fired up over this. Take it easy and try not to get your *** kicked again. [img]smile.gif[/img]

I agree with this.

The general rule is, you are only able to throw the first punch of you feel your life is in danger. Obviously you were walking away and he ran toward you to attack you from behind, so you weren't threatening his life in any way.

Wow.

And how old are you? I'm not asking you about your age to knock you, but if a grown azz man attacked a younger person FROM BEHIND, got on top of him and started attacking him I would have arrested the other guy. Seriously. Unfortunately you did threaten the both of them, and the guy had something you didn't at the time for your statement: a witness.

Also, why did you confront the woman instead of your father doing it, and why did you do so in that manner? You shouldn't have threatened anyone, that puts you in the wrong.

Oh, by the way, if someone is attacking a person of much smaller physical stature, that could be considered deadly force (at least in Military definition). Case in point, if I were being attacked by someone who was bigger and stronger than I was by a large margin and had no backup, I could justifiably use deadly force to defend myself if I deemed necessary (say if I were getting pummeled by someone pinning me down like in your case). Why didn't the local PD see the obvious danger to your life in this situation?

These people are abviously not very mentally stable to both verbally and physically assault another family. My advice is to steer clear of them. Don't think of doing anything stupid, okay?

I think there is more to this story than we've heard. No matter how mean the cop was, it defies logic that the police did'nt arrest & charge the guy that attacked you, based on your account of the story.

Oh man, the odds are against you. Even if you do go to court, the police report will validate their argument.

I say talk to the superior of that officer and see if you could get another police report. If nothing else work, get an attorney and sue. It would definately be a big mess.

civil court...sue for medical bills/pain & suffering..as far as the Disorderly Conduct...no worries...its just a misdemeanor...once i got Abstruction of Justice for giving a van full of staties both fingers..haha..yeah they were not pleased...anyways...because i had a clean record (and my lawyer) ...i just got an ACOD (adjurnment in contemplation of dismissal)..means if you stay out of trouble for 6 months the charges are dropped...this is pretty commonly used in the criminal court system...if you get a lawyer this is most likely what you'll get...either that or a fine...which in my opinion would be WAY better than getting community service...to satisfy possible curiosity...they usually take two sets of prints...one set goes to the FBI and is recorded in their database...one set is kept by the town that arrested you...from now on if you wanna cause some trouble..you gots to wear gloves haha [img]smile.gif[/img]
