    Unfortunately, as late as April 2003 it is illegal in Virginia and West Virginia for employees to discriminate against smokers in their hiring policy.

    HOWEVER

    If this job was in Washington DC, then Stefan you are about as far out of line as the lawyer that wanted to remove "God" from the pledge when his child didn't even attend school yet.

    If this job was in DC, then I know you would want to apologize to the people that you implied legal action against, as that is just as wrong as actually bringing legal action against them. Akin to: "You know, if I wasn't so nice, I'd stab you in the eye" being constitued as a threat of bodily harm.

    But if this job was in VA then you are correct and it is illegal to discriminate against them.

      course then again i've never had one too many cigarettes, had a car wreck, possibly kill someone, bla blah...
      yet you can with alcohol. besides that, all of those chemicals you just listed? there are a thousand time that in the air around dallas (i use dallas since you have texas listed) at 163 times the epa's "safe levels". i think i would like to not hire anyone from within a 100mile radius of dallas. the carcinogens might have leached into there clothes and make me ill.         That sux, go get them for that.. I'm a non-smoker, but I do agree 95Batmobile smokers do smell bad after they smoke.. I have no problem with people smoking because that's their business.. I'm allergic to smoke.. Most of my friends smoke and my mom does too, so I'm around it all the time.. My bf doesn't smoke either..

          there is a sort of dichotomy to discriminating against smokers. the federal government has spent a lot of time (and money) proving that smoking is a drug and addictive. one of the protected classes, is mental disability including drug addiction (and alcoholism). so if the feds are not going to protect smokers from discrimination, then smoking must not be addictive? which is it?

            smoking affects everyone, not just the smoker.. whether he's courteous or not. Why should a company have to suffer because of your addiction?

              My mom has smoked since she was 16. she is 45 now.

              She hacks constantly. Her cough is worse than when I had bronchitis a few times. She gets VERY irritable when she doesn't have a cigarette. She doesn't smile fully in pictures because her teeth are yellow. She smokes at least 2 packs a day. Her breath and clothes reek of smoke. I hate it.

              I've noticed that my coworkers who smoke are routinely late coming back from regular 10-min breaks, and they also take frequent smoking breaks throughout the day. this leaves me hanging while we have a rush of customers.

              I always sit in the nonsmoking section of restaurants because I can't stand the smell of smoke.

              Not hiring someone because they smoke is not discrimination. It's in the best interest of the company to hire nonsmokers. smoking is a choice that you make, not an inherited trait or disability, therefore it should not be protected by law.

                There are some resturants and some bars that are here that are smoke free now..

                I don't know how long my mom has smoked but she's going to be 58 in Feb. She hacks all the time some nights she keeps me up because she's coughing all night and sneezing.. Her allergies kill her most of the time.. My dad and I have told her to stop smoking but she won't listen to us.. She makes up excuses why she has to smoke my favor one is *I can't stop smoking because it's too hard*. If it was too hard to quit smoking the people who have smoked for years couldn't stop.. I use to smoke but I only smoked for a month or two then I stopped.. It's kinda embarrassing when all of my clothes smell like cig. smoke, but it's people's own choice if they want to smoke or not.. My grandpa use to smoke years ago and the doctor told him if he didn't stop smoking he wouldn't see his children grow up and see his grandchildren.. After the doctor told him that he stopped.. I told dad we should take mom to the doctor and see if he would say the same thing but I don't think she would stop if he did say it..

                  Ok, I will be the one who shall stand up for the smoking public.

                  First off, thank you Stefan for noticing that discriminatory ad in the paper. No way should a job be on the line because of a LEGAL act by one human being. Until smoking tobacco becomes illegal, non-smokers will just have to deal with the smoking public.

                  NOW, before you all rip me a new one, I want to explain. I DO NOT condone smoking around non-smokers. Everyone has a choice to breathe fresh air, at least within an enclosed environment. I just choose to puff on a cig rather than hacking at someones face with a hatchet, you know, to calm down. And I really have no problem sitting out in the rain, snow, heat, and cold to smoke a cig. The only thing that pisses me off to NO END, is when I am outside, and some non-smoker comes out and stands RIGHT NEXT TO ME, and proceeds to ***** about me smoking. Usually, I like to exhale a big puff of smoke onto the ***hole who said it, because I didn't ask that dumb*** to stand right next to me. I have made the choice to stand out in the elements to get away from you health freak, non-smoking tree huggers. When you a-holes come outside and piss and moan about someone smoking around you, WALK BACK INSIDE!!!!!! You non-smokers won your fight against smoking in the workplace, and that is good, because you do deserve clean air, but don't come outside and proceed to lecture me about smoking around you. You made the choice to stay inside with the fresh, air conditioned, filtered air, I make the choice to stand outside and smoke. So walk you happy, *****y, tree-hugging *** back inside and do some spreadsheets, or trade jello recipies around the watercooler, or whatever you non-smokers do, and LEAVE ME THE **** ALONE!!!!

                  BTW, where are you non-smokers working that the smoking people at your place of businesses are getting smoke breaks whenever they want??? What ****ed up place did you arrive at when your train left the station??? I have never, Never, NEVER worked anywhere that would allow someone who wasn't on break to just stop working and smoke a cig. I get to smoke 6 cigs while I am at work, 2 for my first break, 2 during lunch, and 2 on my second break. And within the state of Indiana, in an 8-hour working day, you are allowed 2 breaks and a lunch. I get the same treatment as the non-smokers, same lunch, same breaks. I just choose to smoke rather than drink large portions of coffee. No wonder you people think that smokers are lazy, you are all working somewhere that allows the smokers to smoke whenever, which I have honestly NEVER HEARD BEFORE IN MY LIFE!!! So don't go critisizing all smokers and saying that they are lazy, and get less done in the workday because they are allowed to smoke whenever they want, because not all of them are.

                  All this crap has now made me light one up, so for you non-smokers, this puff is for you. :cool:

                    You made a point Mogobs30th.. When a smoker goes outside to be nice and a non-smoker stands right next to you and b*tches, I've seen it before, it just irritates me enough though I'm a non-smoker.. They want to just rub it in your face that you have to go outside in freezing cold or hot weather and they get to stay inside.. Sometimes I feel sorry for the smokers because they have to go outside to smoke in cold weather.. At my work the assistants that smoke they have to wait to go on their break to smoke but the managers that smoke they can go outside to smoke whenever they want.. At my bf's work the smokers go outside to take a smoke break whenever they want.. At my mom's work I think you can only have one break and a lunch.. I guess it just depends on where you work.. Some smokers aren't lazy at all but some are.. The ones I work with work just as much as I do if not more..

                        I work in a supermarket. All a smoker has to do is say "I'm going outside to smoke", and they're gone for 10 minutes. This will happen 2 or 3 times in a 4 or 5 hour shift. Double that for an 8 hour shift. No questions asked.

                        I won't b!tch about someone smoking outside, that's where they belong.

                          Honestly, I don't think any business should allow it's employees to smoke, at work at least. It's not an essential such as eatting or taking a break after long hours. There are no positives to smoking other than digging your grave a few years earlier and keeping the cancer centers open.
                          You'll probably say that it calms your nerves after a hard day. Well, drinking a lot of alcohol calms me down and I loosen up. Let's all have a drink during the break tomorrow.

                            I agree with that alot. Smoke breaks bother me alot, why od they get ot randomly disapear for 15 minutes.

                                does the law say anything about hiring and not hiring based on if someone smokes or not?

                                BTW.. I bartend at TGI Friday's and if you smoke.. you can do it alllll day. I one day sat in the back, by myself, and was not smoking. Then proceeded to get reprimanded for not working. Until I said that I'm taking a "non-smoker's break". hehe, that shut her up.. btw she smokes
