  • Hit by drunk driver.

    Long story short: Hit by drunk driver, car likely totalled.

    My question is, I plan on keeping the car. It isn't in that bad shape, but the cost of the repairs is close to the value of the car.

    If I keep the car, odds are I will have to pay out-of-pocket even after insurance cuts me a check. Shouldn't I be able to recover this cost from the guy, since he was at fault. I mean, if it weren't for him, I wouldn't have a totalled car!

          yes, get a lawyer....also your insurance company should total your car (if damage is more than car is worth) if you had full coverage and then sue the person that hit yous insurance company to cover your claim.

          Now, you should be able to buy your totalled car from your insurance company for pretty cheap as well...

          Same thing happened to me...my Z28 was totaled by a drunk driver...but im stationed in germany, and they put my totaled car up for bid - minimum bid is 300 euros/dollars....if someone bids more, the claim they give me is that much less, then they give me the highest bidders money - which was 900 euros....which was uber cheap for them!!!

          make sure any extra that are not insurance coverable or not stock are OUT of the car...

            If he's got insurance, his insurance will likely total out the car & cut you a check for the value.

            If he does'nt have insurance, hopefully your insurance company will cover that type of thing and cut you a check like above. (You may want to check the fine print of your policy)

            Either way, you'll need to pay out of your own pocket to buy back your car at a price a junkyard would be willing to pay.

            If you were'nt injured, it won't be worth getting a lawyer. The property laws are pretty cut & dry and its not likely you'll see a dime more than the KBB of your car.
