I look at it like this:

If he had committed a felony, weather he lived a rich life or lived in the street, his *** would be thrown in prison for the same amount of years. why should this be any different? Its not like this was a pure accident, in a collision 99.99999999% of the time there was human error, meaning there was something he could have done to prevent this. But he didn't. he screwed you and your letting him off the hook. I do commend you for your sympathy for the guy. I truly do. If I had a lot of money I would like to think I would be caring enough to let him off too. But I don't. In a sense he stole your car from you and doesn’t have the money to get you another one. and that’s just wrong.

i'll do whatever i can.. i've already faced the fact that i won't be able to have a nice car. i just can't get past the fact that i'm going to get raped in the a.ss in payments for a pos.

but, yeah. i'm going to fight. and i'm going to see if i can sue. i am by no means letting him off the hook. my insurance broker is working on getting some kind of info as i sit here typing. and i am probably going to go to the police and tell them that this guy had no insurance. see what they can do.

".. ...its so unfair to jack our insurance up b/c of age and gender i mean chix drive just as bad if not worse that we do but they can get a ls1 or corvette when they turn 16....we gotta wait till were 25 "

that's no joke. it pisses me off the amount of girls (not women) that i see driving transams z28's SS's and even Vettes. and they DO wreck more than guys. i asked my insurance agent why i have to pay so much because i'm male. she said. girls have more fender benders.. guys have more wrecks that total vehicles.. girls do wreck MORE... but they aren't as serious.

just had an idea, email Domestic Violence since he is in texas anyway and ask him how this usually goes down, without any insurance I mean. I am sure he has seen it a time or two and will know the best move for you, besides a lawyer anyway.

he's posted on this thread before.. i'm sure he'll respond when he see's it again. but just incase:

Domestic Violence, what can i do? he did give the officers that showed up at the wreck an insurance card that said he had insurance. I believe he knew he didn't have insurance but can't prove it. Should i try and contact the officer that took the information and tell him that this guy was driving without insurance??

The cops at the scene didn't ask for his proof of insurance? Or did you not even call them? PLEASE tell me you called the cops.

i called the cops.. they took his insurance card that said he was covered. obviously he paid a premium got the 6 month card and then never paid again. this way he still has the card that says he covered for six months when in reality he has been cancelled. all the cops look at is the card and the expiration date. it said he was insured.

Sounds to me like he could have more problems then just a lawsuit. DEFINITELY follow up with the police.

sell HIS kidneys on the black market ;)

no wonder they cant coordinate information to stop terrorist attacks. In New York they can get your insurance information off you liscense plate number. I was in a motorcylcle accident and my registration and insurance was in a compartment under the seat, but was the campartment was so mangled it wouldnt open so they just pulled all that info off the plate number and never hassled me about the paper copies. whats the deal with these other states.

there is so much variation from state to state, company to company, but I 'think' that in your might show a claim against it and your rates will be based on that one claim (claim like turing turning in a busted windshield) rather than an at fault accident involving damage. From what I understand, claims are rated at a much lighter weight than at-faults. But then again, I put buildings together, not insurance packages.

but, it wasn't my fault so it shouldn't be an 'at fault' claim on my insurance, right?

how come you haven't seen any money? how did you get the car if you didn't see any money? also, did the person who hit you have insurance?

Thats what I was trying to say. I think this should show up as just a simple claim which shouldnt affect your rates nearly as much as an at-fault accident. Now if you turn in a busted windshield in a couple months and then repair work for somebody who hit you in a parking lot 6 months later and start racking up the number of claims, then it will start to skyrocket or even find yourself denied coverage if you try to switch to a different insurance company just because the see the number of claims in your history as too much of a liability, even if you werent really at fault because of any of them.

Some of those small things that you turn in to save yourself a couple hundred bucks beyond the deductible arent worth it if you all of a sudden have something like this happen, and then you have multiple claims working against you.

Again, Im not an expert.... just talking based on my own experience dealing with insurance companies and paying attention to the stories of people I know (and believe).

well i'm hoping you're right and my rates don't go up very much if at all. it IS a really big claim though. there is a good chance that the bird is totalled so i'm sure that the 12,300 blue book value i'm going to want isn't going to make the insurance very happy.

there's noway i'll be able to afford a v8 until i'm 25 so i was thinking about an 02 or 03 nissan sentra SE-R.. anyone have any ideas as to what kind of car i should get? keep in mind that i may have 12,000 to spend.. i welcome everyones input because i'm going to need a car pretty quick.
