  • Automatics (switchblades) illegal in USA??

    Got this from another forum...
    what do you think?

    *******************************************

We are in a mall down in Houston this past weekend. As many men, I carry a pocket knife. I carry a Benchmade Model 9100 Automatic Elishewitz Stryker. This is not a pretty knife by any means but it is amazing in quality by any standards.

I carried into one of those high end knife/tobacco shops in the mall that professed to sharpen knives. Mine has never been sharpened and it is due.

When the old fart pushes the button and flicks out the blade, he looks at me like he just caught me eating a **** sandwich.

old fart: "Where the hell did you buy this"

    me: " Military PBX"

old fart: "Are you law enforcement"

me: "How is that any of your business"

old fart: "Because these damn things are illegal, and it is pieces of crap like you carrying these things that endanger good honest people and promote drugs, filth, and whatnot. And I am not going to give it back to you! You can consider this knife mine!"

By this time I have a small mushroom cloud coming out of the top of my head.

A: He said he is going to keep a $300 knife? Did I hear him right?

B: Did he just call me a piece of crap in front of my daughter?

Ok He is about 2 feet from me and I can't beat his *** without landing in jail so I just push a 2 foot ceramic deer statue of the top shelf right beside us. He drops the knife to catch the statue, and I pick my knife up and walk out. A rent-a-cop stops and ask me if I have the knife and if he can search me because it is illeagle. I said "I have no knife, and no you may not search me. If you choose to push this farther I will have you summarily fired without prejuduce. (yes this was a bluff)" And kept walking.

It is 2005 people, shouldn't we worry more about friggin guns than a switchblade?

the guy did sound like an idiot. if he had a problem, he should have called the police or a rent a cop or something to settle the dispute, not start trashing the guys stuff to get his knife back. who spends 300 bucks on a switchblade anyway. if its illegal, then he shouldnt have it.

i must be sheltered, cause i feel no need to go around toting weapons. if i needed a knife and a gun to function in my surroundings, id probably save up and move.

I have a "switch" blade too.
I dont know about the whole US, but in CA switch blades and butterfly knives are illegal. Mine isn't spring loaded, so its legal. And the guy who thinks carrying a knife makes you scum needs to be ****ing stabbed in the face.

butterfly knifes and fixed blades are illegal to carry in ohio. I always have atleast 1 on me, most of the time i have 2-3 knifes (bootknife, folder in pocket, and either fixed or folder on back of my pants). things are only illegal if someone catches you ;)

Just saw this, thought should let you guys know:

Under Penal Law § 265.01(1), a person is guilty of criminal possession of a weapon in the fourth degree, a class A misdemeanor, if he possesses, inter alia, a "gravity knife, switchblade knife, pilum ballistic knife, [or] metal knuckle knife." Under this provision, the mere possession of one of the listed items constitutes a violation of the law. See People v. Talbert, 107 A.D.2d 842, 843 (3d Dep’t 1985); People v. Dolson, 140 Misc.2d 240 (City Ct. 1987); cf. Penal Law § 265.01(2) (criminalizing possession of any dangerous knife "with intent to use the same unlawfully against another"). These per se illegal knives are specifically defined in the Penal Law. See Penal Law § 265.00(4) through (5-.

Various exemptions to the possession of illegal weapons are set forth in Penal Law § 265.20. With respect to weapons other than firearms, these exemptions include possession by law enforcement, prison and military personnel, id. § 265.20(1)(a)-(e), (2), and the possession of a switchblade or gravity knife while hunting, trapping or fishing pursuant to a valid license, id. § 265.20(6). Although firearms that are otherwise per se illegal to possess (pistols and revolvers) may be possessed by individuals licensed to carry them, see id. § 265.20(3), there are no provisions for the licensing of otherwise illegal knives.

i'd rather take my chances with the law and protect myself against the thugs

switchblades illegal???? DUH!!!!! have been for a long time.

Ilike what you did to get it back from being stolen. Who's tosay the shop keeper wouldn't keep it himself. But you also asked for what happened too.
Buy a quality sharpening set & proudly'privatley display the knife in your secure home. If it gets confiscated at alater date because you refused to NOT carry it around, too freakin bad.

switchblades are not illegal, if if, you have the knock off with %5 or less spring assist.

                              I have a %5 Ohio legal switchblade.

Anything can be called a switch blad if you push a switch n it pops open. Weather your doing ll the work to open it, or not. Its the spring tension that is use to open the blade, and that is what makes it illegal or not.

                              Ohio, its 5%
