A license to drive is a privilage, not a right. With said privilage comes responsability.

He DID stand up and say that... But the punishments are too severe for this particular incident. The cop even said it!
John Grisham once said that a liberal is a conservative who has been caught and punished. So, I guess from this thread we can deduce who has had a ticket/accident before. When I was 18, I got my first ticket. 67/40. I paid all $235 and went 90 days without another one, actually I still haven't gotten another one... and I think it's safe to say I learned my lesson. The punishment was effective, just a fine. No hike in insurance... etc. I don't know why they feel like they have to get tougher on kids, they're the same as they always have been.

Did you read my post? This will end up getting reduced to improper driving. A fine, possible mandatory defensive driving class, and that's it. How is that too severe?
Sure, maximum penalty for reckless is revocation of license and jail time... but that's for reckless with intent to kill, i.e. illegally passing while doing 90 mph in a school zone while drunk. What he did exactly fits the description in the VA code books for improper driving... but because of a stupid loophole in VA laws, police cannot issue "improper driving" tickets, they have to issue "reckless driving" and then the judge reduces it to improper. Dumb policy but assuming the judge knows how to do his job it works.

You all are missing the point of his post. He doesn't deny he should have probably been more careful.
He doesn't think there should be a criminal charge and I agree. No other person or their property was harmed, nor was there intent to commit a crime. Therefore the state does not need to be involed. There was only damage to his property and that is surely lesson enough.
I have not read Virginia's failure to maintain control law but surely the intent of it was to criminal charge those that harmed other people or their property through not maintaining control of their vehicle. In this instance the State his protecting SirShaun from himself which isn't the State's job.
EDIT: I didn't see there was a second page of posts before I posted this. I read those posts and some people tend to think he should be punished because of a what if scenario if another car had been there or if something bad had happened to another person. However, it is not the law's job to punish for what might have happened, it is the law's job to punish for what DID happen. In this case what DID happen was that he harmed no other person or their property. The letter of the failure to maintain proper control law probably does allow a ticket in this case but I would bet a ticket in this case violates the intent of the law.
blah blah blah whatever... this thread is beyond silly. SirShaun argues that he is the best driver in the world and know as much as someone who has been driving for 30 years. Which is anything but the case. This kid is a dangerous, immature driver that puts other innocent people in danger. :rolleyes:
mjparme you’re being a bit naive. There is no way you can argue that he was able to maintain proper control, which is why the citation was filed against him. Plain and simple... SirShaun failed to maintain proper control of the vehicle he was driving... how can anyone on this site argue against that FACT?
Lets look at his driving history in the past 4 months since he turned 16
-hydroplaned off a road and into a ditch because he took a turn too fast.
-was street racing against a civic when the civic lost control and flipped twice.
This young kid is in need of reevaluation of his PRIVELEDGE to drive (yes the privilege to drive, not the right to drive). It only takes a few seconds either way for an accident like this to become a fatality, and quite frankly SirShaun I don't think you want to live with that resting on your shoulders. You need to realize what you’re doing out on the road and how it can impact those around you... you need to grow up and stop driving until you do. You are a danger to everyone out on the roads.

Why don't you quit chastising somebody who just made an honest mistake: posting up something that he could be flamed for. Oh well, you are the resident *******... I just wonder what you're compensating for.
An honest mistake is still a mistake, and it was a dangerous one. Anyone driving a car has the power to kill whoever is in or out of the vehicle, and that power must be kept in check, and it must be respected. If something happens which shows that power is not under control, then law enforcement will check you, on behalf of the citizens they are responsible to/for.
*yawn* End up in ditch and have to get towed out of it, with a cop involved? Get a ticket. Simple. Get over it.

You locked up the brakes (hence the tires were screeching). Locking up the brakes causing hydroplaning and doing it into a turn. Experienced people would have known the limits their car and would not have taken that turn so fast.
Sounds like you were driving to fast for the weather conditions and lost control of the car. Sorry but sounds like you deserved the ticket to me.

A hair to harsh but very true. He has dodged 2 bullets you know what they say 3rd time is a charm. Like I said last night learn from your mistakes and talk nice to the judge and you will probably just end up with a fine and the lesson.
