its not that you dont have any rights, its that the rest of us have the right to not die from something we refrain from doing, merely cause we choose to go to the same public locations as people who do smoke..

If businesses can improve their ventilation to the point where I wont smell like smoke simply from walking inside, then by all means, allow people to smoke indoors...

but as such, this helps more people than it hurts...

Hasn't really damaged businesses at all around here. Smokers just go outside. It's not a matter of smokers not having rights; it's a matter of keeping carcinogens out of the bodies of those who do not wish to inhale the cancerous fumes. I love it because the air is so much cleaner inside the bars and restaurants and I don't have to take another shower when I get home! :D

The problem is, bars and restaurants aren't public locations. It's private property that someone is running a business on. And the property owner should have the choice to allow or ban smoking, depending on how they want to run their business. If I go to your house you should decide if I can smoke inside, not the gov't.

Simply put, market forces should decide it. If a bar owner thinks his business would be better off nonsmoking, he should open it that way and attract patrons that want a nonsmoking bar. Owners who decide business would be better with a smoking bar can do likewise. And patrons can choose which bar they want to go to - and enough people spend their money at nonsmoking bars over smoking ones, more bars would go nonsmoking.

They just passed a smoking ban here in Arizona too. As much as I like the effects (being a nonsmoker), I don't think it's my right to dictate to private property owners how they should run their business. I vote with my dollars by avoiding the bars in town I know are smoke-filled and drink at the ones that have better air.

When you smoke in a public place, other people have to breathe it. I have asthma, so even taking in a couple of breaths can give me an attack. No one should have to worry about that in a public place. If you don't like it, don't smoke.

Been that way in Florida for a while. I worked in a restaurant where there used to be a smoking section ... hated it. Cigarette smokes causes my nose to go nuts and I hated the smell. I hate smoke, so I like the law.

It's been like that in Calif. Now they are trying to ban smoking in beaches.

I guess I can't blame them. The beach is just litered with cig.butts. I swear it's like an ashtray.

I just don't understand why smokers won't throw their butts in the receptickles.

ok, maybe a bar isn't technically public, since they are held by private owners... but they are open to the general public... and since the vast majority of people can enter this place (being of legal age of course), it should be that the are should be safe for the general public...

Imagine a work environment that allowed safety hazards, simply cause the person running the equipment knew the risks, and if sh*t happened and some bystandard got hurt, ehhh.. oh well.. thats the risk of working there?

Listen, I'm not against smoking.. everyone has the right to do whatever they want to their body that is within the means of the law. but they do not have the right to do to onto others anything, even if the act is protected by the law as legal.

Like I said... if these places wanted to allow smoking inside, then it should be a requirement that they upgrade their HVAC systems to filter the smoke more efficiently... There are current regs dictating teh amounts of certain air borne things, like particulates and the such... why not the stuff in cigarette smoke? hell, id be all for it.. regulate the amount of stuff allowed in the air, make it legal to smoke indoors, and fine the sh*t out of any place that allows smoking, but doesn't ventilate and filter the air enough to meet regulations... then we all win.. smokers can still smoke, the rest of us can still breathe, and business owner's can decide if they want their businesses (private property) to be a certain way...

                              Re: **** ohio

When they passed that law here, a lot of small bar's set up a little fund... If you wanted to smoke in the bar, you donated a couple of bucks. If the bar got caught allowing patrons to smoke, they'd get fined, and the owner would pay the fine out of the little fund jar and they'd repeat the process. Now, I don't know how many times they let that slide before they shut the place down or something...

I know it sucks for you smokers, but the first time I went to the bar after that law passed, I woke up the next morning feeling great. That's when I realized it was the haze of smoke that caused all the irritations of a sore throat and general crappy feeling I had and not the alcohol. Who knew? So thanks! :)
