  • Dealing with Insurance, any ideas?

    Ok so here's the deal, my roommates car got hit by a drunk driver and then ramped my Firebird (there's a thread with pictures around here somewhere). Anyway, I'm now dealing with the drunk guys insurance company to get payment for my totaled car. They originally offered 4,075 and agreed to add on $375 for aftermarket parts. Now, this is a somewhat reasonable offer but I've seen them at dealerships for more, so I decided to do some research and see if I could get some more out of them. I'm dealing with State Farm by the way. They use NADA values, so I go to NADA and I look up the used value of my car, I get three values

    Low Retail - $3000
    Clean Retail - $4075
    High Retail - $4950

    So obviously they're using Clean retail, which I look up the descriptions and my car is definitely better than Clean retail, but certainly not as high as High retail. In my 100% honest-with-myself opinion, based on those descriptions, it's worth somewhere in the middle.

    So I call and ask. I'm told that system is different that the NADA system they use, and they just get one value, $4075 (statistically the probability of them using a complete different system and it being that same # are next to nothing)

    But whatever, so I ask if there are any different categories. No, she says. So I argue a while longer about the fact that you can't just classify every car the same and finally get her to admit that they are actually three categories (three you say? I'm seeing some similarities here in the different "systems")

    She said everything about my car seemed average (you mean you could tell the paint on the ramped car wasn't perfectly glossy? and that the interior rittled with glass and leaves didn't look perfect either you say?) and that very very cars are ever classified as above average. So how can you call that a reasonable system where you classify anything and everything as average?

    It's not even about the money anymore, it's the principle that they lied to me first of all, and that obviously they just call every car average to save time - which is complete bull ****

    So, I plan on calling back, again and again. But does anyone have any other ideas of what I can do? I only have one number, and it's an 800 number. I'd like to complain farther up the ladder but don't know how to get names or numbers. If anyone has any ideas I'd appreciate it. I may not get any more money, but they won't get rid of me that easy. :D

    I've never had to deal with totalling out a car, but why don't you try to find similar firebirds in your are and show them how much they are selling for. That is a better representation of market value than NADA.

      Tried that, also tried using black book, blue book, and edmunds "True Market Value" they disregard anything that's not the NADA value from their system (including NADA from the web). They wouldn't even hear me out as far as other used cars go, I offered to send them links to autotrader, cars.com and local newspaper classifieds and I got "That's ok, we have access to that information" :bs:

        Unfortunately, no-one wins out with this situation.

        I don't think you really have any leverage to get more money; Insurance companies deal with unhappy people all day, not being their customer puts you at the bottom of their priority list.

        Insurance companies screw people, that's what they do. I would move on & let it go.

          the only real way to attempt to get more money out of them would be to get a lawyer, you could possibly threaten first and see if that gets you anywhere but in all likelyhood that is the only way to bring them to the table. Of course once you go down the lawyer road you loose 1/3 so you are back where you started. Also more than likely no lawyer worth a crap would touch it for that little bit of money.

          You could try the lawyer threat and see if that brings them to the table but I doubt it. Without you being a customer like someone said you are at the bottom of the list. Now if the guy that did it is worth some money you might be able to sue him but again that's going to be a tough road. Honestly in today's world just be glad that he had insurance.

            well just ask to speak to thier supervisor, and be respectable.

            explain the situation to them and ask what they can do to help you out, also say that you were considering switching insurance to thier company and how they handle your situation will greatly influence if you switch to thier company. you got to make them want to help you

              i know a lot of companys use the galve book . they try to tell you it's a bussness only book so the public cant look at it . another way to beat you out of your money . take um on like a pitbull to a mailman .

                What you can sell your car for and what dealers are selling for are very different. You can't use sell prices for your argument.

                I think the price they offered is far; however, if you want to go up the chain, find the e-mail address of the CEO. That's what I have done (see my GE thread).

                    i'd just take the money.
                    also demand payment for any extra expenses you've had as a result of the accident - typically rental car or any documented expenses that you can relate to the loss of use of your car.
