Ok, here's the deal. I was picking up a grill (prebuilt) for someone from the local home depot. They had two teenage guys load it into the truck for me. While doing so on their first attempt they started to try and smack each other from around the sides of the grill causing them to drop it and scrape the back of my truck. I immediately asked for a manager and dealt with store management from there. They put in my claim to Sedgwick CMS, I have waited over a month for a reply, being promised by the manager at home depot my claim would be acknowledged and taken care of. I got the reply from Sedgwick claiming the home depot is not liable for the damage the employees caused due to the fact it was in the parking lot and that is not their liability. Am I missing something or should I take this back up with the manager or the claims office? Wouldn't the fact that the home depot is the employer of the teenage idiots make them liable since they would not let me load up the grill (they said employees had to)? Any suggestions are greatly appreciated.

make it seem like you enjoy the store but are unhappy with the incident, don't get all huffy/puffy about how you will never come back, just infrom them you are unhappy, but might come back.
Then hopefully they will give you alot more free **** then the cost of your car.

Go and fall and bust your *** in the parking lot and see if it's their problem guranteed it will be. I just got a grill from lowes and almost got in an argument with the guy on wether the box would fit in the maro. Really grinds my gears.Let's flip a coin. Heads I get tail, Tails I get head.

Somebody owns or leases the land that the parking lot is on. I'd put my money on Home Depot (or Sedgwick CMS) being the lease holder/land owner. Update (for anyone who cares) I called store management (I was being very polite) was told to deal with claims office and that they cannot disclose any information or continue to talk to me. I got hung up on....remember i was being very polite. I call claims office, they say they cannot disclose any information regarding their decision, sent me on my way. I called corporate office for home depot, they told me to call claims (which i already did) and then proceded to tell me to talk to the store manager (already did). I thought the purpose of corporate was to override all the b.s. I am truly upset and I am 100% sure home depot or tony stewart will never receive a single penny from myself or my family ever again. I am so fed up with this, it's a world gone crazy!

tell um youll sue . usally gets them going . I know from experiance working for a company that does snow plowing for commercail bussness that you have to carry insurrance(spell) to cover eveything . weve been sued before over a person who claimed to fall on the only patch of ice in the lot . anyway thats what the insurance is for .

FYI.. claiming to sue will do one of two things.. 1. make them listen and immediately help you. 2. them telling you the conversation is immediately over and that you can only reach their attorney from now on...
It's their fault, dont get me wrong... They own/lease the property, it was their employees, its their policy to load vehicles, their employees are on the clock.. not much of an agrument they have, other than giving you the run around until hopefully you give up.

^ correct, and more often than not the second one. I work in the same office with the campus attorney and anytime anyone even hints at sueing he just says have a nice day tell your lawyer to contact me when your ready to follow thru on your threat.Let's flip a coin. when you claim to sue, it usually shows, situation is over and courts will solve it.
this coming from a guy who is a manager at a public place that ~30,000 people a week go through, and 3/4s of the place is dimly lit, and has stairs with coke and butter on them.
When someone starts spewing lawsuit, I just cross my t's dot my i's on paperwork, and go overboard. You skin your knee, I have an ambulance there, giving you medical treatment. Anything that involves any sort of physsical contact between two people or property damage, I have a cop there taking a report. You ask for free stuff, I send you to our corporate office, and inform them you instantly asked for free stuff which usually screams scammer.
If something happens you are reasonable, and not a pyscho, I'll give you the world of free ****... who cares its not my stuff anyways, would rather customers be happy when its on my shift. I give out free ****, until someone yells at me for giving out free ****, which is usually never if it is something that keeps a customer happy.

threatening to sue home depot won't do anything...empty lawsuit threats work well against mom-and-pop stores, but a corporate juggernaut like Home Depot will just say "we look forward to speaking with your attorney" and hang up. As soon as you drop that L-word, all dialogue will stop b/t you and any home depot representative, and they'll only speak to you thru your attorney.

Well, I never considered the lawsuit route, too much of a hassle. I will just make sure I never spend another dime at that store; Lowes is just as good (same with harbor freight). Corporate tried to call me back and when I spoke to them they kept saying they are sorry they can't do anything. I told them nevermind, you have lost a customer, their family, and friends from shopping. Where we live lowes is literally across the street ; )
