man don't give up on it, you were just getting that tune to come around. Damage is hood, fender, radiator, headlights, and such?? How does the kmember look?
yeah man, from looking at the pics,. that is mostly stuff you can bolt on. headlight mounting brackets might be a pain to get straight,.. but the hood is an easy swap, the bumper you can get for less than 200 off ebay.. hell, even teh intercooler you could prolly straighten most of the fins.. did it even damage the radiator?
unless i'm missing something from teh pics, you could prolly fix that for not too much (well minus paint at least.. )

looked at the car more today. the frame is pretty bad and definately would need a new radiator and new radiator support along with having the frame straightened and pulled, along with 4 body parts all being painted. more than likely the car is going to be parted out and sold as is as a running cam only car with no front end... but its all still up in the air right now. one thing is for sure, it will never be like it was again.
I will say: you cannot control nature. You did your best to avoid hitting an animal. As the result you wound up ruining your car and hurting yourself & someone hurt to some extent--cuts and bumps, but at least everyone is okay. Then you wind up with the with an a*s of a cop.
I spin out quite a bit on dry surfaces--enough to make my back-end swerve out a bit, but there has to some loose gravel or dirt on the road to do it. It's even worse when you make a turn, spin out, and then fishtail outward.
If you think about it.. it all depended on how you were going to break. Since you where turning (if I read that right), going about 35, saw a dear, swerved out of the way of a dear--followed by stepping on the breaks (pretty hard)... then I can say: Yes, you most definitely would have fishtailed into something because your car would have pulled to the left or the right depending on the turn you made at the time you applied the breaks.
Even if you were going straight and applied the breaks too hard to avoid something with Open-Diffs your car probably would have pulled your back-end to the right (or could be the left. The last time it happened to me felt as though it was to the right). I'm not sure what LSD would do to you at this point.
