  • Is this worth fighting?

    So I live in New Jersey and my girlfriend goes to college down in salisbury, maryland. I haven't seen her for about a month so we talked and I would go pick her up and bring her back for the weekend, and her parents would drive her back. Well..on my way, about 15 - 20 till her school I am cruising along what I thought to be a 55 mph road, which is was for a long *** time before I see a 35 mph sign, and about the same time I see a cop car chilling on the side of the road. I slow down and pass him, and he pulls out right away. I get pulled over and get a 57 in a 35 mph. $128 ticket. Would going back to Delaware to fight this be worth it not to get the points on my record? I don't have much defense, besides I wasn't aware of the speed limit change.

      You really don't think it's worth fighting. I talked to my mom she said the insurance company said I have to try and fight it or I'm going to be screwed. I've read stories on here about worse offenses then I have and people got off ok.

        You could possibly argue that you just had snow tires installed on your car for the upcoming winter and the oversized tires knocked off your speedometer and you were unaware of the speed you were traveling.

            You can put snow tires on just about anything.

                I own a Firebird, but I was driving my sisters ford escort because of the fuel economy. I would probably of spent double on gas if I drove my Firebird. You really don't think if I argue that the first time I noticed the 35 mph sign was exactly the same time I saw the cop car, it would be a good defense. Now I'm not sure if they're were speed limit signs there before I saw the one that the cop was sitting by, but if they're wasn't, dont you think thats a little unfair? To catch someone right as the speed limit drastically changes like that?

                  For the record, if I was indeed doing 57 before I passed the first 35 mph sign, isn't that not really against the law? Until I actually passed the 35 mph sign?

                    usually, if there is a big change in speed limits, there must be signs a few hundred feet before hand, warning you to slow down. Not sure the law where you got pulled over, but if they didn't have a necessary sign for such a thing, then you may have a defense.

                    but more than likely, the cop was sitting in one of his favorite speeding traps. prolly has heard it all before from other people he got a the same spot. You're prolly screwed and will be payin the ticket..

                      I don't have a problem with paying the ticket, as long as I don't get the points on my record.

                        i would say try fighting it.. i fight everything even if i know i was wrong.. so far im batting about 80% success on my battles.. or they will at least get it knocked down a bit.....

                          i agree, fight it and see what happens. the worst that could happen is that you have to pay the full ticket anyways but you'll probably get it at least knocked down. i got pulled doin 20 over and they dropped the ticket and made me do that f**kin driver improvement class but hey it was worth not gettin any points on my license and not havin to pay the ticket
