    My roomate and I are both leaving our apartment sometime around mid-May. We're trying to sublet, but he wants to jack up the rent on the subletter's by over 200 bucks to try and make some money back on all of his worthless furniture, appliances and kitchen supplies that he won't be taking with him. I want no part of this, so I proposed that he keeps the rent that I've already paid for the entire month of May (so he doesn't have to give me back half of it if he sublets from mid-may to June) in exchange for me being written off the lease regardless of when/if the subletters move in. He agreed...i drafted up an agreement so we have it in writing, but I want to make sure this will cover my @ss legally before we sign it.

    Lease Annulment Agreement

    Between tenants: Mario Lemieux (roomate) and Wayne Gretzky (me)

    Both tenants agree that Wayne Gretzky will be written out of the lease agreement and/or relieved of his tenant obligations as of May 15th, 2008 for apartment number 1140 at 301 Front Street West, Toronto, Ontario. Wayne Gretzky having already paid his final month’s rent to Mario Lemieux will be relieved of his tenant obligations including paying subsequent month’s rent (June through August) and maintaining the apartment for the remaining months of the lease agreement.

    Dated: April 10, 2008

        I work at Staples and they sell all these different types of lease forms. Is that what you have or is this something you wrote up yourself?

          no this is something i wrote up myself because the circumstances are pretty unique (like the fact that I'm leaving mid-month, I've paid already, and that I would otherwise have several additional months on the lease).

            I think that's pretty straight forward, is he the type of guy to screw you over later after things don't go his way?

              I don't think he would be the type to screw me over...although I've only known him for 8 months. In my opinion he's pretty honest, but he's incredibly cheap. I told him he would be able to get most of the money back just by selling the furniture seperately, and he agreed for the most part except that he's worried he wouldn't make his money back on 'the little things' like kitchen supplies that he spent a few hundred on.

                  Ughh.. roomates, tenants, renting, is all a big headache. I'd discuss this issue first and see what the reaction is. Then sign all paperwork. Goodluck.

                    yes, huge headache. That's why I want to wipe my hands of it. We discussed the first issue and he seems okay with it.

                          Its short and sweet and a decent lawyer could punch holes through it all day.

                          You can write up all that you want but if its not with the manager/owners of said property I dont think it holds alot of weight because you agrred with them. Also what does your lease aggreement say about subletting the place. Is it acceptable? If its sub-letted and they damage it then the manager/owner of said property will come back on you and your roommate.
