My roomate and I are both leaving our apartment sometime around mid-May. We're trying to sublet, but he wants to jack up the rent on the subletter's by over 200 bucks to try and make some money back on all of his worthless furniture, appliances and kitchen supplies that he won't be taking with him. I want no part of this, so I proposed that he keeps the rent that I've already paid for the entire month of May (so he doesn't have to give me back half of it if he sublets from mid-may to June) in exchange for me being written off the lease regardless of when/if the subletters move in. He agreed...i drafted up an agreement so we have it in writing, but I want to make sure this will cover my @ss legally before we sign it.
Lease Annulment Agreement
Between tenants: Mario Lemieux (roomate) and Wayne Gretzky (me)
Both tenants agree that Wayne Gretzky will be written out of the lease agreement and/or relieved of his tenant obligations as of May 15th, 2008 for apartment number 1140 at 301 Front Street West, Toronto, Ontario. Wayne Gretzky having already paid his final month’s rent to Mario Lemieux will be relieved of his tenant obligations including paying subsequent month’s rent (June through August) and maintaining the apartment for the remaining months of the lease agreement.
