KY student asked to leave mall because dress was deemed to short
Re: KY student asked to leave mall because dress was deemed to short
Thats like a nun's outfit that she is wearing compared to what I see here in Canada on a daily basis! Somepeople need to grow up (mentally) and realize that this isn't the 50's and 60's anymore and that styles have changed!
They say we live in free countrys (USA/Canada) ,but sometimes it looks and feels as if we live in countrys where we are free to do whatever they let us do!
Re: KY student asked to leave mall because dress was deemed to short
First, this is not a discrimination case. The security guard supposedly removed the girl because her outfit was too revealing. This is basically a speech restriction, because it regards her right of expression (i.e. to wear what she wants.) She was removed because she was supposedly disturbing other shoppers, not because she was a woman.
Second, there may or may not be a cause of action for violation of some sort of free speech right: some states recognize under their constitutions the right to protection of speech in a privately-owned shopping center, others do not. It appears Kentucky courts have not ruled on the subject, although I'd have to research further to verify that.
Third, another cause of action she has is probably for sexual harassment or intentional infliction of emotional distress, for the way the security guard looked her up and down. The way Fox reported it the security guard's behavior seemed inappropriate, and possibly tortious.
And no, that dress is not too revealing. It's pretty conservative really.

What? This happened 30 min away from me and I never heard about it. It is a good thing those that complained didn't come up to campus this week (sorority girls in sundresses EVERYWHERE)
