  • A sad day for me (pictures inside)

    It was around 9am - 9:15am in the morning. I was on my way from the bank to the mechanic to get an oil change. Driving down Lanza Ave. It was a slight drizzle going on. I was approaching an intersection (Main St.) when I was hit in the front left portion of my Firebird.

    When I was hit I saw the other driver (lets call him Driver B for now) had the stop sign, therefore I technically had the right-of-way.

    I sat in the car for a moment to gather my thoughts. Curse myself out for not going to the other bank in the morning, so I would have avoided this accident. (But given the theory of time and change: It already has been set, and no matter how, you will always get into the same predicament. (Little Physics joke...))

    It seems I was hit in the middle of the intersection when he was attempting to go straight. I was hit so hard that there was enough force to drag me off to the right along with his truck. My air bags did not deploy. I believe I was going down the street doing the speed limit because there was a lady in front of me. Through her windows you could see her talking on the cell phone who turned (without signaling) onto the same street Driver B was supposed to be sitting at the stop sign. He claims she almost hit him while she was making the turn.

    I was headed down this main drag as the picture shows. Vehicle B would have been going from right to left in this photo:



    You can see my Firebird pushed off to the right after the impact. (I did not move my car until the cops arrived and was told the move it off the street...)

    You can see the hood and the right fender also buckled due to the impact.

    The lights functioned, except the turn signal/parking light was crushed inward. The same with the left right was completely crushed. I was leaking fluids at the time as well, but the engine started fine.

    Now I ask: Who is at fault. The cop says it was his because he had the stop sign. Sucks.... I just got a new insurance policy back in August... =/

      If he had the stop sign and disregarded it, then it's his fault. Even IF he stopped, then proceeded through, it wasn't safe to do so.

      No need to worry about contacting your insurance company, unless the driver of the truck doesn't have any...
      You insurance payment(s) should remain the same because you were not at fault in this.

      Where in NJ did this happen?

          Garfield, NJ (about 5 or so blocks from my house). Garfield is near Passaic and Lodi. Progressive told me due the age of the vehicle that they might just total it. =/

          I had just put in a new transmission about a year and a half ago, radiator about 8 months ago, tires, brakes, rotors about 2 months ago, and whatever junk I left out the list.

            Sorry to hear about that. Make sure the police report is accurate. Was he issued a ticket for running the stop sign?

              hey man i feel for you, I just hit a deer last night and I'm pissed. I wasn't even going 10mph. it more or less hit me and crushed my fender. my whole front will need to be redone. I'm thinking about just getting rid of it and going up to buy another bird

                As far as I know it, he told the cop he stopped, but didn't see me. He only saw the driver in front of me who made an unexpected left onto his street. So I'm guessing now ticket.

                As for the police report. I get to see it in 5 days. He said he put down both statements. I wonder if he put down exactly what I said. He asked me how fast I was going, and I told him "25-28 Mph as there was a car 3 car lengths in front of me and the lady was on the cell phone." :P But as far as that goes he did not issue me a ticket either.

                  yeah that definitly sucks.... because they will total it... some dude turned across 3 lanes of traffic and i was the lucky one to hit him... completely his fault... and mine wasnt even as bad as yours and it was totalled... mine had brand new tires, was full of gas, and a new clutch, and was like 3 months from being paid off.... yep... i wasnt a happy camper... it'll work out ok though...

                    hey not to be mean, but if your car does get totalled can u grba 1 piece off your headlight? I've needed it for like 6 months now lol. I'm hoping I can straighten all my stuff out after yesterday's incident

                        If his insurance makes you and offer and you think it's low, Tell them no thanks I think you'll be hearing from my attorney unless you make a serious offer. You will be surprised how much they increase their offer when you threaten to get a lawyer involved. Make sure you know the Blue book of your car from KBB.com and what they cost in your area to replace it. They have to put your car back into the condition it was in prior to there insured hitting you or replace it with something compatible.

                          ^^^ good advice.

                          And if they do total it, be sure to show all receipts you have for mods and upgrades put into the car. You can get some compensation for your work. Not all, but something is better than nothing. Sorry to hear about the car. People are just so careless on the roads these days, it's hard to keep something nice. I'm currently waiting on a settlement for some guy that blindly backed into my car.

                              The only mod I had was Kristen's SLP CAI. :P... but I did have a new transmission put in that was 1898$, Front Brakes / Calipers / Rotors (680$), new tires with 2000 miles on them (720$). Not sure if that all counts. I babied it.
