i may sound stupid but why not if it is 40 over b/c the piston sheet tells me it is for sure 40 over at 3.840?

I think he is trying to get at the fact that it weakens the walls of the pistons....
potential....
but not likely to crack a block.

Viper is pointing out an important factor here, perhaps the most important consideration thus far.

forced induction adds a great deal of stress...all over the place.

can i do a different cam? can i do nitrous? what can i do?
