And I am right as there is a disclaimer on the estimate that he is legally supposed to be provided with. On top of that the insurance gives him notice as to which option he wants. Whether to take the check and leave it at that. Or take it to the shop and be able to receive more checks for the supplements,if there are any. And yes, cashing the check means he will get nothing further. But, if he still has the check at hand, it can be still be either way. His best bet is to keep the check and sell the car. Otherwise he takes the car to the shop. Shop does a teardown and finds out about hidden damages. Supplements the insurance. Then risk the chance of the vehicle to be a total. And gets one more check to add up to the grand total of the market value.

    I gave him some options to give the insurance company. I new they would/will not take them. The point was for him to get something in writing from the company on thier decision. This proves he has tried to work it out with them and they are refusing to be reasonable. Reasonable would be to fix his car the way it was or give him the fair market value for it. Since he did not file a police report and does not have a lawyer yet, he needs to get an much documentation as possible. This will help his case in the end.
    He isn't even tellin us the whole story. I don't know what he has received, other than a check and an estimate. And on top of that, you say that reasonable would be to fix his vehicle or give him a fair market value. That is EXACTLY what he said the insurance is doing.

    Documentation for what? How is he getting screwed. The reason he said he thinks he is getting screwed was because he got another estimate from a shop and was comparing it to the appraiser's. I'll say it one more time, the appraiser can only write up what he can see. He cannot speculate on what MIGHT be damage. So he received the check for that amount. Now, he has to take it to the shop to start the repair process and to have the shop supplement the insurance IF there is any additional damage. BUT, he is afraid of the possibility of the vehicle to be a TOTAL loss. He said they told him to bring it to the shop to "revise" the estimate. Which basically means they will start repairing the vehicle and look for additional damages. And if there is more, to the point of that 80% then the car is totalled. He isn't going to loose the check no matter what. If it's repairable, then the check goes to paying for the repairs. If he chooses "as is" then it's his to spend and he can leave the car as is or sell it, or if it's a total, then he will receive an addition check. So, how is he getting screwed?

      If screwed he is it is self inflicted. An apprasier will only see what he sees. He will not rip the car apart to see what else there is.

      He already took it to a shop and got the estimate. So I fail to see what the problem is now. The most an insurance company will pay is 80% of the market value. I doubt they will add in the value of anything added. Not without a fight anyway.

      He has an estimate of $3700 or so to fix it. Fix it. The insurance people will pay up to the 80%.

      Or take what he has and sell the car. IIRC, someone wants it for about 2K. Now he has 5k to put toward another car.

      If that is not enough he have to sue. No lawyer will get involved for the miniscule amount it will be. So off to small claims he will go.

      And more than likely lose. He will have to provide several estimates, and the lowest one more likely than not will be the one that is picked. Better to take what they gave and sell the car.

      What is the statute of limitations on it anyway? How long until the insurance guys are no longer obligated to pay anything?

      Forget the guy who did it. There is no crime because there is no police report.

      Bottom line. Get the car fixed. Or sell it. Too much time has been wasted.

        Thank you Mr. ABH. He still has some time, so there is no worries. Check hasn't expired and he can simply say he is locating a shop he would like to repair at. I've seen some people take in their vehicle 2 months after they have their car inspected by an appraiser. And I've seen body shops who supplement a yr after the vehicle was in the shop!! :eek:

            I understand all this stuff now with the insurance company and their will to give money for repairs. I figured it's causing me more headaches trying to figure out how to get more out of them for this repair I can hopefully just sell the car as is and take my check, whatever I get for the car, and call it done.

            Thanks again though guys for your help. After looking at things and numbers I can see where they got their estimate from. I can see that they are pretty close to what it would take to repair my car.

                Happy to help Srunger. You just have to ask yourself some questions. Before the accident, was I thinking about taking on the task of trying to find a new car with limited funds, or was I happy. When the accident occured, did anyone defendant, insurer,defendant's company...anyone try to bring satisfactory closure to the event by offering you a fair and equitable settlement for your inconvenience and loss. And finally, is what this insurance company offering me in any way an assurance of being put back into the same condition I was in before the accident. (i.e. a useable, operating,appreciable, viable means of transportation that you were accustomed to.) If you cannot be put back where you were before the incident, these people have wronged you. If they have proven to be fair, move on with life. And to address a remark about my Toyota Corolla and the "pirate body shop", my objection was not that the car was repaired and resold, it was that the insurance company actuall equipped and funded a crooked adjuster in the project. And my friend, I've stared into a mess of sunsets in this life and I can tell you...the world is full of crooked stuff. But Thank God, "where darkness abounds, grace doth much more abound".                   Full coverage would have saved you a lot of hardack with this. Just something to think about for the future.

                    Full coverage would have also costed me alot more per month in which I don't think the car is worth. Maybe when I'm 40 and full coverage is cheaper, but being 22 it's not getting any cheaper.

                      Yea I know, it will not drop till you are 25. To save some cost you can raise your deductable to 1500. Not to mention if you are "at fault" you would be out the entire amount of fixing your car. Accedents happen. As long as your happy that's all that matters. [img]smile.gif[/img]

                          I am glad you understand and are kewl with everything spunger. I think you should keep the car and just keep driving it. Not worth it to sell it just to get another car if you don't have the dough. Well, I got to go, I have files to type up for the insurance company. I'm an appraiser too btw...

                            Nah I got my pickup if I need another car.

                            I got a buyer interested in it for $2500. I figured $3063 + $2500 is a good enough deal for me on the car. In reality I've had more problems with it so this is a perfect chance to get rid of it. Plus it's a deal to the buyer, where else can you get a camaro like this for $2500 that is fine short of the rear.

                            It always works out in the end.
