I was running past E. so me and my dad went to fill it up. Our tanks are 16.8 gallons right.... well my dad put 17.38 gallons in my car? how in the hell is that possible

Well, he may have topped off the filler neck and the lines going to the evap canister thingie. Seriously though, you shouldn't be running it that low as it really stresses the fuel pump which is $$$$$.

Not the SLIGHTEST clue as to how that happened... Maybe if it were cold I could see gas contracting making less volume, requiring more gallons to fill the tank but it shouldn't be off by THAT much...
What I would do is reset your trip the next time this happens and see how long it takes to before you're empty and divide the number of miles by your tank size giving you your MPG... If you have your normal MPG then you are fine and it was a fault at the pump... If it is a bit HIGH then the pump was correct...

I've had that happen on my car and on other cars I've owned, when the tak is REALLY empty, it goes past the "rated capacity" of the tank. Maybe the manufacturer adds a little room past what they tell you just for a safety margin. Or maybe it's just when you really fill it up to the filler neck.
