Your backing out of a parking space...

  • Your backing out of a parking space...

    Anyone know the legalities?....Lets say your backing out slowly in your f-body and theres a big truck blocking your view to your right, so you slowly creep out and out of nowhere a car comes zooming by and crashes into your rear right side. Would this most likely be a 50/50 thing the insurance companies would workout?

    Or is the person backing out going to be at fault 100% of the time

    It would probably be the guy whos backing up's fault.

      No, thankfully :tup: . Im just talking "what if".

      I was wondering if there's much of a gray area with these backing out situations...Because I find myself frequently being boxed in on both sides by tall trucks and vans/SUV's. All you can do is reverse slowly and hope anyone who's coming along is driving slow and paying attention to you. Not to mention watching out for pedestrians sneaking up on you

        i think thatd technically be your fault, im not 100% but isnt the ones driving got the right of way? so they would prolly say u should have looked or soem ****... shru the guy in the other car would wanna kill u to :-p hahaha

          It'd probably depend on where on the car they hit you at exactly.

              So maybe, the only chance you have is if you can find a witness that says the guy who "had the right of way" was driving too fast or not paying any attention to the car backing out and had enough fair warning?

              Or have an insurance guy investigate the damage or some crap

                I usually have to back out slowly either way ... huge blindspot in a convertible! 0_o;

                  id heard before that all paking lot accidents are 50/50 (assuming both cars are running/have drivers)

                      not sure where u live but i believe in texas it just depends on how far the car is already out, wether ur backing out or pulling out. say if ur backing out and ur atleast 50% out there and they hit u im not 100% anyway but pretty sure its their fault. by then they should have noticed and slowed down or stopped, either way i wouldnt want to hurt my baby by hitting or getting hit by anyway so guess u better be extra careful and avoid the whole situation lol.

                          Absolutely, I always park as far from general population as I can. If there are no "good" spaces, then I usually keep driving. I hate it if anyone parks next to me.

                          Whenever I go someplace with a crappy parking lot, I take the wife's Jeep. ;)

                            I do that, but the when we get boxed in by tall vehicles we have to worry about our mile-long front end getting taken out while we slowly inch forward.

                              Definately the person backing out of the spot's fault.. you have to be sure traffic is clear before proceeding to pull out.
